Dialogue with the state

On April 25, Free Energy took part in the meeting of the Working Group on State Policy Formation in the Renewable Energy Sector

On April 5 of this year, Anatoly Nikolaychuk, director of strategy and development of the Free Energy company, took part in a meeting of the Working Group on issues of state policy formation in the field of renewable energy.
The event was held by the State Agency for Energy Efficiency and Energy Saving of Ukraine at the initiative of the Ukrhydroenergo Association. The meeting discussed issues related to the improvement of the conditions for the development of the small power industry, as well as other issues relevant for companies developing small hydropower projects in Ukraine.
The participants of the meeting noted that in order to improve the conditions for the development of the industry, it is necessary to make appropriate changes to a number of laws and by-laws regulating relations in this area.
Based on the results of the discussion of the identified issues, the following proposals were made by the Working Group participants:
· As part of the implementation of the "National action plan for renewable energy", the Association "Ukrhydroenergo" proposed to address the Cabinet of Ministers of Ukraine with a request to take measures to increase the state importance of small hydropower as an industry with renewable energy sources. To study and subsequently apply at the state level the practice of Georgia regarding small hydropower development programs.
· It is proposed to make changes to the Law "On Local Self-Government" in terms of defining a 30-day deadline for approving small hydropower investment projects and issuing relevant permits for construction and connection to networks.
· View Resolution No. 321 of the CMU (On Approval of the Procedure for Issuing Permits for Special Water Use), regarding the terms of issuing permits for special water use for hydroelectric power plants. Today, permits are supposed to be issued for a period of 3 to 25 years, but in practice, the relevant authorities issue them for a minimum period. In order to prevent abuse, it is necessary to add to the text of the Resolution that for small hydropower facilities, the validity period of permits for special water use should be at least 10 years when the corresponding permit is re-obtained.
Association "Ukrhydroenergo" plans to develop and approve at the level of the Ministry of Energy and Coal Industry of Ukraine a plan of measures to popularize small hydropower.
The Free Energy company initiated consideration of some issues regarding the improvement of the working conditions of companies that invest in the development of small hydropower plants in Ukraine. The company proposes to simplify the land acquisition procedure for renewable energy facilities.
"In the absence of a detailed plan of territories, the provision of land plots from state or communal property is prohibited. But in Ukraine, there are many places where these plans are not available, which is a big problem for investors who do not have the opportunity to arrange a plot of land for the construction of renewable energy facilities," said Anatoly Nikolaychuk, director of strategy and development of Free Energy.
During the meeting of the Working Group, the Association and its members were asked to consider the issue of drafting a draft law on amendments to the Law of Ukraine "On Regulation of Urban Development" regarding the allocation of land plots for power generation facilities.
In addition, it was proposed to initiate an appeal from the State Efficiency Agency to the Verkhovna Rada with a request to speed up consideration of the draft law on amendments to some legislative acts of Ukraine, regarding the simplification of the land acquisition procedure for the construction of facilities for the production of heat and/or electricity using renewable energy sources and/or biological types of fuel (reg. No. 2529a), introduced by People's Deputies of Ukraine O.H. Dombrovskyi, A.D. Livik and Yefimov M.V.
